Dedicated to summing up the results of activities in 2021 the extended meeting of the Collegium of the Pridnestrovian Prosecutor's Office was organized via videoconference. The working discussion was attended by the leadership of the prosecutor's office, the prosecutors of towns and districts, the military prosecutor, prosecutors, the heads of state authorities and local self-government were invited. The PMR Prosecutor Anatoly Guretsky made a presentation. The information presented by him was heard by the PMR President Vadim Krasnoselsky.
According to Anatoly Guretsky, the prosecution authorities received 4860 complaints about violations of human and civil rights and freedoms in 2021 (las year there was 381 more). 4484 were considered, 749 were satisfied. 609 people attended personal appointments during the year. 1895 violations of the law were revealed in the reporting period. Increased attention was paid to checks of compliance with the legislation on citizens' appeals at the insistence of the President. The ongoing scheduled inspections revealed a significant number of violations - one and a half times more than a year earlier (476 facts). Most of all complaints were addressed to the Ministry of Health, the Ministry of Finance, as well as the State Service for Environmental Control and Environmental Protection. Anatoly Guretsky recalled that the PMR President repeatedly pointed out the importance of the personal involvement of the heads of state authorities and local self-government in the process of considering citizens' appeals. The prosecutor informed about the development of law-in-draft with mandatory participation in this work. The speaker drew attention to the fact that a careful and comprehensive consideration of citizens' appeals made it possible to detect and eliminate legislative conflicts and legal gaps. He gave specific examples.
The number of complaints about violation of labor rights has been halved compared to 2020 (from 490 to 255). The problem of violations by local authorities of the legislation on providing housing for orphans remains relevant: 10 facts have been identified. Anatoly Guretsky informed that a large prosecutor's check is planned for the first half of this year in this regard. There are questions about the legality of the distribution of agricultural land.
The prosecutor of the republic focused on the topic of a noticeable decrease in the level of crime, noting that, there are no noticeable improvements in the quality of the investigation despite the decrease in this regard the workload on law enforcement officers. One of the most problematic aspects is official red tape, Anatoly Guretsky emphasized. There were cases of illegal detention of citizens, as well as facts of release from custody with the termination of criminal cases on rehabilitating grounds, information about which was later found to be unreliable. At the same time, the number of complaints received by the prosecutor's office regarding supervision of the investigation and inquiry has decreased for the first time in 8 years.
Anatoly Guretsky, analyzing the activities of bailiffs, highlighted such problematic aspects as delaying measures to establish the property status of debtors and to search for them.
The speaker focused on the topic of amnesty, denoting cases of illegally adopted decisions in this sphere.
Speaking about staff changes, Anatoly Guretsky emphasized that this is aimed at improving the activities of the prosecutor's office. The appointments of 2021 - early 2022 include prosecutors of Bendery, Slobodzeya and Dubossary districts.
A separate report at the meeting of the Collegium of the PMR Prosecutor's Office was made by the Military Prosecutor of the PMR Vadim Dengovsky. He spoke about the measures aimed at maintaining military discipline, improving the legal framework, current and upcoming tasks facing the Military Prosecutor's Office.
The Chairman of the PMR Supreme Court Adrian Penkovsky voiced his comments on the information provided by the speakers.
Based on the reporting data, Vadim Krasnoselsky gave a presidential assessment of the activities of the prosecutor's office of Pridnestrovie. He noted after listening to the reports the positive changes in terms of generating reports and presenting information. The PMR President noted the importance of general supervision. He focused on the topic of citizens' appeals, emphasizing that he would support the law-in-draft that requires the heads of departments to personally get acquainted with the statements addressed to them and control the execution. It is unacceptable according to the President to leave consideration of appeals at the mercy of clerical workers. Another area that Vadim Krasnoselsky paid attention to is deputy requests. The PMR President emphasized that it is about the same appeals of citizens in fact.
The prosecutor's office was instructed to carry out verification activities in terms of the involvement of departments in the electronic document management system and the effectiveness of this mechanism.
The President focused on the issue of improving the legal framework, recalling that the prosecution authorities have the right of legislative initiative and should actively use it. Vadim Krasnoselsky mentioned an important principle: all legal conflicts and legislative gaps should be read in favor of the citizen.
The President urged to pay special attention to the implementation of legislative norms on land, subsoil, forest and water resources. It was instructed to conduct checks on the facts of the transfer by economic entities of the land allocated to them by the state for rent and the illegal receipt of profit in this regard. The reaction should be withdrawal, transfer to the Redistribution Fund and transfer to conscientious land users.
The enforcement of the law that restricts citizens, who take drugs in driving vehicles, remains under special prosecutorial control.
Concluding his speech, Vadim Krasnoselsky emphasized that the Pridnestrovian Prosecutor's Office retains the function of a coordinator in the interdepartmental interaction between law enforcement structures and ministries of the economic bloc.
The President recognized the work of the PMR Prosecutor's Office as satisfactory.
