Chiefs of the Constitutional, Supreme and Arbitration Courts were able to directly discuss with the President at the Presidential Executive Office the prospects for improving the judicial system, legislation, and the difficulties that the courts face in their work. Vadim Krasnoselsky reminded that many topical issues were raised during the final plenary sessions. Today's conversation on the most significant aspects of the functioning of the judicial system, is intended to become more substantive.
The Chiefs briefly outlined the functions and powers of the courts headed by them. According to Oleg Kabaloyev, Chairman of the PMR Constitutional Court, today most of the appeals are received from citizens. The Chief emphasized, not a single state authority applied to the Constitutional Court in 2018. Focusing on the practical aspects of the work, Oleg Kabaloyev explained why the court does not always accept appeals from citizens for consideration. According to him, often the problems with which citizens come to the Constitutional Court do not correspond to its competence and specificity. These statements are redirected to the Prosecutor’s Office of the PMR or the Commissioner for Human Rights, the court director stated. Speaking about the improvement of legislation related to the activities of the Constitutional Court, Oleg Kabaloyev noted that specialists monitor all changes in the work of the Constitutional Court of the Russian Federation. Oleg Kabaloyev said that if they coincide with our realities, then we come up with the appropriate legislative initiative. He stated that all changes made to the law on the Constitutional Court, which was adopted in 2002, were aimed at improving the efficiency of the court.
Chairman of the PMR Arbitration Court, Alexander Kiyko, in turn, considers that the current legislation in arbitration does not need to be corrected today. According to him, if the changes are initiated, they should be reconciled and coordinated with the Arbitration Court.
Vladimir Rymar spoke about the work of the courts of general jurisdiction and the Supreme Court. According to the Chief, over the past 10 years, the courts of first instance consider, as a rule about 38-48 thousand cases annually. One judge has about 60 cases per month or 2-3 cases daily. The Chairman of the Supreme Court of the PMR said that over the past decade, it has been possible to solve problems related to the delay in the consideration of cases and the lack of court clerks. However, the Supreme Court and the courts of general jurisdiction cannot independently cope with individual difficulties, stated Vladimir Rymar. Among the most acute problems is insufficient material and technical support. According to him, some of the buildings of the courts are in disrepair. City and district courts are in need of transport. For many judges, the housing issue is relevant, noted Vladimir Rymar.
The President, after listening to representatives of the judicial system, drew their attention to the fact that logistical issues can be resolved in the framework of the capital investment program. Now for the state in the priority social sphere and health, said Vadim Krasnoselsky. In 2020 and 2021, it will be possible to envisage funds for improving the material and technical base of the judicial system. The President focused the attention of the court leaders on the fact that the formation of the capital investment program for 2020 will begin in May of this year, urging not to delay the preparation of applications.
They talked during the meeting about professional development of Pridnestrovian judges. The Chiefs of the courts stated that today the opportunity to take appropriate courses outside the republic is practically absent. Vadim Krasnoselsky, emphasizing the importance of this issue, recommended that the chairmen of the courts form and send a package of proposals to the Presidential Executive Office.
