The President took part in the work of the Collegium of the Prosecutor’s Office of the PMR. The meeting is dedicated to the results of 2018. The analysis is of particular importance in connection with the return last year to the prosecutor's office of the authority to supervise the activities of the investigating and inquiry bodies, as well as maintaining state charges in criminal cases. The conclusion of the results of the semi-annual practice: the reform has justified itself. In addition to the Prosecutor of the PMR and his deputies, the Military Prosecutor of the PMR made a report. The today's meeting of the Collegium was distinguished from similar events of the past years and the wide coverage by speakers of various spheres of the state’s activities in which prosecutors are involved. As Vadim Krasnoselsky noted, previous years the focus was mainly on the internal affairs bodies.
It was noted that the efforts of the units of the Pridnestrovian Prosecutor’s Office focused on monitoring the observance of social rights and guarantees of citizens, preventing crimes, fighting corruption and offenses in the economic sphere, as well as protecting the rights of minors. A decrease of 12.3% in the number of crimes and an increase of 3.6% in the level of their detection were recorded. At the same time, proper measures aimed at increasing the effectiveness of the fight against crime are not taken by all prosecutors, was stated during the Collegium. Corresponding action plans have been developed only in Tiraspol, Dubossary and Kamenka. Coordination activity is recognized insufficient.
With regard to the effectiveness of procuracy supervision, a positive trend was confirmed by a serious increase in the number of repeals of illegal orders of investigators and investigators. Another aspect pointed out by the rapporteurs is the increase in the number of prosecutor's orders, on the basis of which criminal cases were initiated. The prosecution authorities themselves are limited in this right, but they are in favor of giving them a legitimate opportunity to initiate criminal cases in the future.
Some facts and figures from the annual report on the activities of the Prosecutor’s Office of the PMR: during 2018, 104 employees of the Investigative Committee and the Ministry of Internal Affairs were brought to disciplinary proceedings as a result of the activities of employees of the Prosecutor’s Office; 1,100 appeals of citizens on actions and decisions of bodies of investigation and inquest are allowed (402 are recognized as justified); 306 inspections of observance of legality in the places of detention of prisoners were conducted (6 proceedings were instituted, 15 employees of the State Prison Service were held accountable) there are complaints about the functioning of temporary detention facilities for citizens and in terms of the quality of checks. One of the priorities of the prosecution authorities remains the protection and restoration of the violated rights and legitimate interests of citizens. 2007 appeals are solved in the reporting period. 1139 cases of violation of the law are identified. Testing activities of a number of ministries and departments were carried out with a view to enforcing the norms of legislation on citizens' appeals. Identified numerous violations associated with superficial consideration, the direction of unmotivated responses, delaying the deadlines.
Increased attention was paid by the prosecutor's office to the state of law in health care. 93 violations were found. An audit of the activities of the medical control commissions was conducted on the instructions of the President. In addition, they checked the conditions and procedures for keeping patients in social and medical institutions, psychiatric hospitals and departments. There are many violations, both of sanitary and epidemiological nature, as well as regarding the constitutional right to freedom.
Compliance with labor laws is under control of the prosecutor's office. There was 610 cases of violations. 444 decrees have been issued on the recovery of unpaid wages from employers totaling more than six million rubles. 162 organizations in the agricultural sector and food service enterprises were audited. We found out that the contractual relations with 73 employees of 15 enterprises were not formalized.
Another presidential instruction is to check compliance with legislation in orphanages, boarding schools, and correctional type institutions. As a result of its conduct numerous violations of legislation on education and fire safety were revealed.
The participants of the meeting of the Collegium of the Prosecutor’s Office of the PMR were presented with numerous statistical data, final figures, analytical information, achievements and problematic aspects, and numerous examples from the prosecutor’s practice. The Prosecutor of the PMR, Anatoly Guretsky, summing up, emphasized that the constitutional amendments made it possible to make the work of the prosecution authorities more efficient and effective. According to him, concerns about the complexity of the transition to the updated mechanism did not materialize. Its launch was in the normal mode. All roughness polished in working order, said the head of department.
The President aimed the Collegium members at gradual improvement of the legal norms regulating the activities of the prosecution authorities. In addition, he drew attention to the need to strengthen the coordinating role of this agency in cooperation with law enforcement agencies. Vadim Krasnoselsky spoke about the need to develop a mechanism for prosecutorial protection of bona fide entrepreneurs (as part of the adoption of new investment legislation). According to the President, “there should be no meaningless checks.” He considers that unscheduled control measures should be carried out by relevant structures only after consultation with local prosecution authorities. The President also stopped at work with citizens: checks of ministries and departments regarding the execution of the law “On citizens' appeals” should be continued. Another area requiring, according to Vadim Krasnoselsky, constant attention of the prosecutor, is fire safety.
Thanking the prosecutors for their work, the volume of which has increased significantly, the President aimed them at further productive activities for the benefit of the people of the republic. He recommended pay special attention to personnel policy and the creation of conditions for raising the level of qualification of specialists.
