Vadim Krasnoselsky took part in the Collegium of the Ministry of Justice of the PMR

Minister of Justice Alexandra Tumba in the course of the Collegium meeting told about the main indicators of the activities of the Ministry of Justice of the PMR in 2018 and directions for further work. She paid special attention to the lawmaking component. According to the minister, work is constantly being carried out to conduct legal and anti-corruption expertise of draft orders, decrees, resolutions and other legal acts, law enforcement practices are being analyzed, and current legislation is being improved. The registration profile work is underway: 269 legal entities, branches and representative offices (193 commercial and 76 non-profit organizations) during 2018 were entered into the state register. The applicants were denied in registration in 28 cases. Last year, data on 4,761 individual entrepreneurs and 231 peasant farm enterprises were entered into the state register. At the same time, 749 patents officially ceased their activities. Alexandra Tumba told about the work of the Public Services Portal, thanks to which Pridnestrovians had the opportunity to order and receive copying from the state register. The mechanism of electronic registration and re-registration of entrepreneurs is being introduced. All the information stored since 1993 in the books of the registry offices of the Pridnestrovian Moldavian Republic are collected into a single electronic database.

According to the Minister of Justice, the Ministry of Justice issued 550 licenses per year. The work continued on scheduled inspections of organizations. 55 claims for forced liquidation of legal entities were sent to courts. One of ​​directions of the department is the registration of rights to real estate and transactions with it: 29,644 applications of this kind were received in the reporting period. As of the notary: from 2018, the appointment of notaries public on a competitive basis has been practiced. Tiraspol, Bendery and Grigoriopol follow this experience. Another innovation is the provision of document translation services directly at the notary office, the possibility of providing the text of the document requiring translation in electronic form appeared. In just one year, 67.446 actions were conducted by public notaries and 83.526 by private ones. Notary activities are under constant control. In 2018, 11 planned control measures and 4 inspections initiated on the basis of appeals and complaints of citizens were conducted. In the reporting period, activity of applicants wishing to register intellectual property was increased. If in 2017 there were 104 appeals, then in 2018 there are already 144.

The head of the department informed about the interaction of the Ministry of Justice with various government bodies and authorities, services, structures, organizations and the public. She told about the participation of Pridnestrovian expert-psychologist in the All-Russian Conference on Legal Psychology "Kochenovskye Readings" (Moscow, November 2018). Presented at the international event report contributed to the popularization of the legal system of the PMR, the minister said. She reported on the ongoing methodological work. In 2018, the Instruction on the organization of the production of forensic psychological examinations is for example approved, and developed guidelines for their implementation and drafting. Alexandra Tumba drew attention to the especially sought-after types of expertise, noting that the introduction of new research requires the purchase of specialized equipment.

The Minister focused on the activities of the State Supervision Service of the Ministry of Justice of the PMR. She said that inspectors held 4868 events in 2018, revealed 6756 violations, issued 706 prescriptions and 404 submissions. At the same time, the Prosecutor of the PMR has many questions regarding the activities of this particular unit. Anatoly Guretsky said that the impressions on the results of the prosecutor's check were far from positive. He urged the state supervision service staff to get away from formalism, indicating the presence of noticeable irregularities in working with citizens. According to the head of the Prosecutor’s Office of the PMR, there are complaints about the activities of the bailiffs. At the same time, the Minister of Justice told about the significant (30%) staff turnover of the State Bailiff Service. The average load increased over the year by 10% and amounted to 2,310 proceedings per bailiff. Alexandra Tumba said that it is necessary this year to focus on strengthening human resources and improving the professional level of service staff. In this regard, the President called for interaction with PSU and the Ministry of Internal Affairs. According to Vadim Krasnoselsky, it is advisable to create a separate study group in the Tiraspol Juridical Institute, which would train specialists for the Ministry of Justice. In addition, post-graduate training of personnel is important, the President is sure. Referring to the positive experience of the Ministry of the Interior of the PMR, he recommended organization of training process in such a way that every employee, regardless of position or rank, once or twice a year, attends training sessions and passes the exam.

The President also drew attention to the importance of interdepartmental cooperation. The coordinating role in this process Vadim Krasnoselsky assigns to the prosecutor's office. The President urged not to see the supervisor in the prosecutor's office, but to perceive the participation as an aid of an impartial colleague.

Speaking about improving the infrastructure of the units of the Ministry of Justice in particular the State Bailiff Service the deplorable state of which was marked by Head of the State Penitentiary Service Vitaly Ishchenko in his report, the President noted that 6.9 million rubles had been allocated from the capital investment fund to improve the material and technical base. One of the most significant objects is the stationary tuberculosis building, the opening of which in the territory of the penitentiary institution will minimize the spread of the disease among convicts. We also talked about the lack of laboratory, diagnostic and therapeutic equipment as well as a shortage of medical staff: according to 2018 the staffing level of the medical service of the State Penitentiary Service institutions is 87.5%, and for medical specialties only 56.3%.

Another issue raised by Vadim Krasnoselsky after the deputy minister’s report is the activities of the Ostrog State Unitary Enterprise. Established for the employment of convicts enterprise remains unprofitable and is the subject of constant complaints from citizens. According to Vitaly Ishchenko, 321 convicts have been added to the work. 107 of them are working at venue of Ostrog. The system of working time accounting and remuneration makes the enterprise unattractive for employees and therefore inefficient from an economic point of view. Attempts to rectify the situation are being made. Expansion of activities is planned. In addition to traditional industries - sewing, carpentry, building materials and metal products, they expect to produce double-glazed windows (the necessary equipment has already been purchased), process car tires into rubber crumb, produce coating for children's and sports grounds, as well as paving tiles, curbs, gutters. The President urged the government to pay special attention to this enterprise, noting that the state unitary enterprise has all the possibilities for effective operation. Vadim Krasnoselsky drew attention to the importance of the educational role of labor, spoke about the need for the socialization of convicts. The presence of a working specialty and labor skills will allow citizens to adapt more quickly outside the prison and minimize the likelihood of a relapse, Vadim Krasnoselsky is sure. He recommended expanding the list of specialties that convicts can acquire while in places of detention. The President mentioned the subject of parole of detained citizens. The President supposes that the profile of the civil service should be more initiative in this matter.

Summing up the results of the Collegium and the work of the ministry as a whole, Vadim Krasnoselsky found satisfactory the results of the work of the Ministry of Justice in 2018.
